Greenup Recycle LLC (the "Company", "we" or "us") respects your privacy and is committed to protecting it through our compliance with this privacy policy (the "Privacy Policy").
This Privacy Policy describes the types of information that we may collect from you or that you may provide when you: (a) visit the website greenup.nyc (our "Website"), or (b) download, install, create an account on, access, or use the GreenUp Recycle application (our "App"); and our practices for collecting, using, maintaining, transmitting, protecting, and disclosing such information.
This Privacy Policy applies to information we collect:
All of the above points of contact, inclusive of the Website and App, are collectively referred to as the "Platforms."
This Privacy Policy does not apply to information collected by us offline or through any other means, including on any other website operated by the Company or any third party; or by any third party, including through any application or content that may link to or be accessible from the Website.
PLEASE READ THIS PRIVACY POLICY CAREFULLY TO UNDERSTAND OUR POLICIES AND PRACTICES REGARDING YOUR INFORMATION AND HOW WE WILL TREAT IT. IF YOU DO NOT AGREE WITH OUR POLICIES AND PRACTICES, YOU DO NOT HAVE OUR PERMISSION TO USE OUR WEBSITE OR APP. BY ACCESSING OR USING OUR WEBSITE OR APP, YOU AGREE TO THIS PRIVACY POLICY. WE MAY UPDATE, REVISE, OR MODIFY ALL OR A PORTION OF THIS PRIVACY POLICY FROM TIME TO TIME (SEE "CHANGES TO OUR PRIVACY POLICY" BELOW). YOUR CONTINUED USE OF OUR WEBSITE OR APP AFTER WE MAKE SUCH UPDATES IS DEEMED ACCEPTANCE OF THEM, SO PLEASE CHECK THIS PAGE PERIODICALLY FOR CHANGES.
Our Platforms may from time to time link to third-party websites for your convenience and to provide easy access to additional useful information. Should you select such a link, you will leave our Platforms. We do not control those sites or their privacy practices, which may differ from ours. Any personal data you choose to provide to, or that is collected by, such third parties is not covered by this Privacy Policy. We recommend reading a third-party site's privacy policy before providing any personal information there. A link to another website from us does not constitute an endorsement of anything found on that third-party website.
Throughout this policy, "Websites" means all Company-affiliated or -controlled websites and any other microsites or mobile websites we operate or use. "Social Media Pages" are the official social media pages we operate on Facebook, X, Instagram, LinkedIn, and other platforms. This Privacy Policy applies to all our Platforms (or pages or tabs within them) that feature our services, and to our communications with you via text and email that reference the Website or App.
PLEASE BE AWARE THAT IF YOU ELECT TO HAVE US SHARE YOUR INFORMATION WITH THIRD PARTIES, THOSE ELECTIONS WILL SUPERSEDE ANYTHING TO THE CONTRARY IN THIS PRIVACY POLICY.
We reserve the right to amend this Privacy Policy at our discretion and at any time. It is our policy to post any changes on this page, with a notice on the Website home page that the Privacy Policy has been updated. If we make material changes to how we treat users' Personal Information, we will notify you by email to the primary address on your account and/or through a notice on the Website home page. The date this Privacy Policy was last revised is identified at the top of this page. You are responsible for keeping us updated with an active, deliverable email address, and for periodically checking this page for changes. Your continued use of our Website or App after changes are posted constitutes your acceptance of those changes.
PLEASE NOTE THAT FOR CALIFORNIA RESIDENTS, THE CALIFORNIA CONSUMER PRIVACY ACT ("CCPA") AS REVISED BY THE CALIFORNIA PRIVACY RIGHTS ACT ("CPRA") GOVERNS OUR USE AND YOUR RIGHTS WITH REGARD TO YOUR PERSONAL INFORMATION.
You have the right to request information about the types of personal information we share with third parties and the identities of those third parties for the immediately preceding calendar year. To obtain this information, email info@greenuprecycle.com. Please allow up to thirty (30) days for a response.
When you access our Website, and/or download, create an account on, or use the App, we collect several types of information from and about you, depending on the context of your interactions with us ("Personal Information"), including:
We collect this information directly from you when you provide it, and automatically as you navigate through the Website or use our services — including usage details, IP addresses, and information collected through cookies.
The information we collect on or through our Website may include:
We may de-identify your personal information so it is no longer personally identifiable, whether by combining it with information about other individuals or by hashing or removing identifying characteristics. We treat de-identified information as non-personal to the fullest extent allowed by law.
Through our communication functionality and interactive features ("Community Forums"), you may have the opportunity to submit information to us. Any content you submit or post to a Community Forum — including photos, audio, video, messages, text, files, or reviews — is a "User Submission." Please note that certain information, such as your name or place of residence, may be publicly displayed alongside your User Submissions. Anything you submit through a public-facing Community Forum may be made public, and we are not responsible for how third parties use or share User Submissions.
Social Networking Features. The Website may allow interaction with third-party services such as Facebook or Instagram — for example, letting you "Like" or "Share" content, or connecting your social posts to the Website. If you share content between the Website and a third-party service (or vice versa), that information may be publicly displayed. We and the third party may each have access to certain information about your use of the Website and that service, subject to this Privacy Policy on our end and to that third party's own privacy practices on theirs.
All personal information you provide to us must be true, complete, and accurate, and you must notify us of any changes.
As you navigate our Website, we may use automatic data collection technologies to collect information about your equipment, browsing actions, and patterns, including:
This information is statistical and does not by itself identify you, but we may associate it with personal information we collect elsewhere. It helps us estimate audience size and usage patterns, and protect our Services against fraud. The technologies we use for this may include:
Our Platforms are a general-audience point of contact and are not directed at children under thirteen (13). We do not knowingly solicit data from or market to anyone under eighteen (18). By using our Website or App, you represent that you are at least eighteen, or that you are the parent or guardian of a minor and have consented to that minor's use of our Website or App.
In the past twelve (12) months, we have collected the following categories of personal information:
Personal information does not include publicly available government records or de-identified/aggregated consumer information. We may also collect personal information outside these categories when you interact with us in person, online, or by phone or mail — for example, through customer support or in delivering our services and responding to your inquiries.
We use the information we collect to understand your needs and interests and to deliver a more consistent, personalized experience. For example, we may use your information to:
We also use information for business purposes such as analyzing your activity with us and monitoring the effectiveness of our communications, responding to your requests and feedback, and improving the content and experience of our Platforms.
We may process or share your data based on: your consent; our legitimate business interests; performance of a contract with you; compliance with legal obligations (court orders, subpoenas, law enforcement requests); or to protect vital interests, such as investigating suspected fraud or threats to safety. More specifically, we may share your information:
Our Website or App may link to or incorporate content hosted by third parties over which we have no control and which is governed by those parties' own privacy policies. We work with advertising, analytics, and other vendors to serve ads and measure effectiveness on our Website or App and elsewhere online. These service providers, and other third parties whose content we link to, may set their own cookies or tracking technologies on your device and collect information about your activity across sites and devices to provide targeted advertising. We may share device identifiers, usage information, hashed data, transaction records, and other de-identified information with these vendors for advertising and analytics purposes.
Security measures. We have implemented technical and organizational measures designed to protect your Personal Information from accidental loss and unauthorized access, use, alteration, and disclosure. Information you provide is stored on secure servers behind firewalls, and payment data is encrypted using SSL. That said, no method of transmission or storage is 100% secure — we cannot guarantee that unauthorized third parties will never defeat our safeguards, and any transmission of Personal Information is at your own risk. You should only access our Website or App within a secure environment.
Cookies. We may store cookies on your computer to save you time, remember who you are, and tailor your experience, including which pages you visited and links you clicked. Third-party advertising and analytics companies we work with may place their own cookies as part of their service; we have no access to or control over those. This Privacy Policy covers our own use of cookies only. To opt out of interest-based advertising, visit aboutads.info/choices.
Other tracking technologies. We (or our service providers on our behalf) may use pixel tags and web beacons to measure visitor traffic, promotions, and engagement with our Website pages and emails.
Retention. We keep your personal information only as long as necessary for the purposes in this notice, unless a longer period is required by law (such as tax or accounting requirements). No purpose in this notice requires us to retain your personal information longer than six (6) months after your account is terminated. Once we have no ongoing legitimate business need to process it, we delete or anonymize it, or, where that isn't immediately possible (for example, information held in backup archives), we securely isolate it from further processing until deletion is possible.
If you are located outside the United States, this Privacy Policy may still apply to you. Information we collect could be stored on servers and shared with third parties located in the United States or other countries, where privacy laws may differ from those in your country. If you believe we are unlawfully processing your personal information, you have the right to complain to your local data protection supervisory authority. Questions about your privacy rights can be sent to info@greenuprecycle.com.
Your privacy choices:
You may also have the right, under the laws of your country, to request access to, correction of, or deletion of the personal information we hold about you. To make such a request, email info@greenuprecycle.com.
If you are a California resident, see our California Privacy Rights Notice in Exhibit A below.
This notice supplements the Privacy Policy above and applies solely to visitors, users, and others who reside in the State of California ("Consumers" or "you"). We adopt this notice to comply with the California Consumer Privacy Act of 2018 ("CCPA"), as amended by the California Privacy Rights Act ("CPRA"). Capitalized terms not defined here have the meanings given in the CCPA/CPRA. This notice does not apply to workforce-related personal information collected from California-based employees, job applicants, or contractors.
The CCPA permits California residents to request, once a year and free of charge, the categories of personal information (if any) we disclosed to third parties for direct marketing purposes and the names of those third parties for the preceding calendar year. Submit such a request in writing using the contact information below.
If you are under 18, reside in California, and have a registered account with the Website, you may request removal of unwanted data you've publicly posted by contacting us with the email associated with your account and a statement that you reside in California. We will ensure the data is not publicly displayed, though it may remain in backups or other systems.
A "Resident" under California law is any individual in California for other than a temporary purpose, or domiciled in California while temporarily outside the state. All other individuals are "Non-Residents."
We may disclose your personal information to a third party for a business purpose, requiring the recipient to keep it confidential and use it only to perform services on our behalf. Each service provider processes information under a written contract with us. Using your information for our own business purposes is not considered "selling" it. In the past 12 months, we disclosed the following categories for a business purpose — identifiers, California customer records, commercial information, internet/network activity, and geolocation data — to our affiliates, service providers, and third parties you've authorized us to disclose to in connection with our products or services.
Access and data portability. You may request that we disclose the categories and specific pieces of personal information we've collected about you, the sources, our purpose for collecting it, and the categories of third parties we've shared it with, covering the preceding 12 months.
Deletion. You may request that we delete personal information we've collected from you, subject to exceptions — for example, where retention is necessary to complete a transaction, provide a requested service, detect or prosecute fraud or security incidents, debug functionality, exercise free speech or other legal rights, comply with a legal obligation, or make other internal, lawful uses compatible with the context in which you provided the information.
Exercising these rights. Submit a verifiable consumer request by calling (718) 821-9413 or emailing info@greenuprecycle.com. Only you, or someone legally authorized to act on your behalf (including for a minor child), may make a request; access/portability requests are limited to twice in a 12-month period. We will verify your identity before responding, and use any information you provide for verification only for that purpose. We aim to respond within forty-five (45) days (extendable up to ninety (90) days with notice), covering the preceding 12 months, at no charge unless a request is excessive or manifestly unfounded.
Sale opt-out / opt-in. If you are 16 or older, you have the right to direct us not to sell your personal information at any time. We do not knowingly sell the personal information of consumers under 16 without affirmative opt-in from the consumer (if 13–15) or a parent/guardian (if under 13). Submit an opt-out request by emailing info@greenuprecycle.com; we will wait at least 12 months before asking you to reauthorize. We are not obligated to re-identify de-identified information to respond to a request.
We will not deny you goods or services, charge different prices, or provide a different quality of service because you exercised your CCPA rights, except as permitted by the CCPA — for example, offering CCPA-compliant financial incentives with your prior opt-in consent, which you may revoke at any time.
As required by the CCPA, we will publish metrics on the consumer rights requests we received from California residents each calendar year, including the number received, granted, and denied, and our median response time. Current metrics are available on request at info@greenuprecycle.com.
California's "Shine the Light" law (Civil Code § 1798.83) permits California resident users of our Website to request certain information regarding our disclosure of personal information to third parties for their direct marketing purposes. To make such a request, email info@greenuprecycle.com.
We reserve the right to amend this notice at our discretion and at any time. When we make changes, we will post the updated notice on the Website and update its effective date. Your continued use of our Website after changes are posted constitutes acceptance of those changes.
